KCSIE sets out safeguarding responsibilities for:

ReMarkAble AI:
- Is not a school or education provider within the meaning of KCSIE
- Does not employ staff in regulated activity with children
- Does not provide teaching, supervision, or pastoral care
Accordingly, statutory safeguarding duties under KCSIE remain with schools, colleges, and employers, not with ReMarkAble AI.
This policy reflects the principles of safeguarding outlined in KCSIE, while clearly defining the limits of the platform's role.
3. Scope and Position
ReMarkAble AI:
- Provides automated feedback on uploaded educational work
- Does not deliver teaching, pastoral care, or supervision
- Does not engage in direct communication with children
Safeguarding responsibility for children and young people does not transfer to ReMarkAble AI by virtue of platform use.
Primary safeguarding responsibility remains with:
- Parents and carers
- Schools, colleges, and education providers
- Statutory safeguarding services
4. Nature of the Platform
ReMarkAble AI:
- Is not a social network
- Does not enable user-to-user communication
- Does not request or require personal information within uploaded learning content
The platform processes educational content only for the purpose of generating feedback.
5. User Responsibility and Acceptable Use
Responsibility for Uploaded Content
Users are solely responsible for the content they upload.
Users must not upload any content that includes:
- Names of children or adults
- Addresses, email addresses, or phone numbers
- School names, class names, or teacher names
- Images of faces or identifiable individuals
- Safeguarding, medical, or child protection information
- Any information that could reasonably identify or endanger a child or adult
All uploaded work must be anonymised.
ReMarkAble AI does not accept responsibility for safeguarding risks arising from users uploading identifying or inappropriate content contrary to guidance.
6. Safeguarding Boundaries
ReMarkAble AI:
- Does not monitor content for safeguarding disclosures
- Does not provide real-time oversight or supervision
- Does not investigate safeguarding concerns
- Is not a reporting route for safeguarding disclosures
In line with KCSIE, safeguarding concerns must be handled through:
- A school or college's Designated Safeguarding Lead (DSL)
- Parents or carers
- Local safeguarding partners
- Emergency services where there is immediate risk
The platform is not designed for disclosure or reporting.
7. Data Collection and Operational Necessity
ReMarkAble AI must collect and process limited personal data to operate lawfully and effectively.
This includes data required for:
- Account creation and authentication
- Payment processing and billing
- Customer support and service communication
- Legal, financial, and regulatory compliance
This data is operational, not educational content.
8. Data We May Collect
Depending on use, this may include:
- Name of the account holder (e.g. parent, teacher, school representative)
- Email address
- Payment and billing information
- Organisation or school name (where applicable)
- Usage and technical data required for secure operation
Students are not required to submit personal data within uploaded work.
9. Payment Processing
Payments are processed via secure, industry-standard third-party providers.
ReMarkAble AI:
- Does not store full card details
- Does not process payments internally
- Uses providers compliant with relevant data protection and security standards
Payment data is used solely for transaction processing and subscription management.
10. Separation of Systems
There is a clear separation between:
- Account and payment data (held securely for operational purposes)
- Uploaded educational content (processed only to generate feedback)
ReMarkAble AI does not combine learning content with personal or payment data for safeguarding or monitoring purposes.
11. Safeguarding and Data Protection
ReMarkAble AI:
- Collects only data that is necessary
- Uses data only for defined, legitimate purposes
- Applies appropriate technical and organisational safeguards
- Does not sell personal data
- Does not use personal data for advertising
Safeguarding principles apply to how data is handled, but statutory safeguarding responsibility remains external to the platform.
12. Limitation of Responsibility
ReMarkAble AI cannot:
- Verify the identity of individuals referenced in uploaded work
- Determine whether content relates to a safeguarding concern
- Be held liable for risks arising from misuse of the platform
Use of the platform constitutes acceptance of these limitations.
13. Reporting Concerns About the Platform
Concerns relating to misuse of the platform (not safeguarding disclosures) may be reported via our Contact page.
Reports will be reviewed to determine whether platform access should be restricted or removed.
